Simmons & Simmons advises Mitsubishi Corporation and TEPCO

Simmons & Simmons has advised Mitsubishi Corporation and TEPCO on the 2,400MW/130MIGD Facility D independent water and power project in Qatar, which reached financial close on April 11, 2016.

The project was the first of its kind in Qatar to utilise reverse osmosis technology on a large-scale, and the first privately financed IWPP in Qatar to involve an international developer since the Ras Laffan C plant reached financial close in 2009.

The development of the project is unique in that it has been fast-tracked by the Qatari government as part of its national development strategy designed to meet growing demand for water and power ahead of the Qatar 2022 world cup.

The Simmons & Simmons cross-border team of energy and finance experts across Europe, Middle East and Asia advised on all legal matters in connection with the project. Industry specialist lawyers led the negotiation and drafting of all finance documents for the borrower and sponsors. The financing has been provided by a consortium of international and local lenders led by the Japan Bank for International Cooperation. The teams also provided specialist input across a range of complex project agreements including the power and water purchase agreement.
